Abhiware Terms and Conditions (Cheapest-Website)

I. PARTIES INVOLVED

These terms and conditions are between the Abhiware company (http://www.abhiware.com) who own
Cheapest-Website.com known hereafter as "The Company" and the end user purchasing the website
known hereafter as "The End User".

II. DELIVERABLES

The Company will create for The End User the website of their selection (Blog, Personal or
Business) using open-source software packages such as Drupal, Wordpress and/or in house
programming.  The End User acknowledges that their payment is for the service to install/create one
of the above websites using a template of their choice from a selection provided to them by The
Company.  In addition to the fees to install the above website, the user will also receive 1 Year
of shared website hosting as well as 1 Year of domain name registration.  The domain name
registration however will be forefitted with no refund, credits or dues by The Company to The
End User if The End User already has a domain name they wish to use other than the one being
provided here.

In addition to the above, The Company will provide email technical support through a ticketing system
which can be accessed by visiting http://www.abhiware.com and selecting the appropriate option under
the support menu.  This email technical support will be available to The End User for a period of 1 year
from purchase date after which this support will discontinue unless The End User renews their service.
The Email Technical Support Ticketing System is only good for technical support
requests such as a website being down or adding an email account.  Website updates or custom programming
is not included at this level and will require payment by The End User to The Company for an additional
fee which will be set by The Company to The End User.

VI of this document.

III. PROMOTIONAL $99 WEBSITE TRIAL OFFER

The Company will offer a complete website package to The End User for a period of one month.  Upon completion
of this month, the user will then receive an option to either fulfill the rest of the year and pay the remaining
$400 owed for the initial downpayment of the complete $499 website or to forefit and end the trial offer with no
additional costs.  Should The End User decide to end the trial offer and not go with the package, as a thank you
for trying out The Company's service, The End User will have their domain name transferred over to them for usage
with any other provider.

The End User will be resposible for all yearly maintenance fees for the domain name and full management of said
domain name.  Once transferred to The End User, the domain name will no longer be property nor responsibility of
The Company and The End User will receive no support or help in regards to this domain name.

When the trial period has ended and the user decides not to continue, no refunds, discounts, credits or
dues will be owed to The End User by The Company as they have paid for the trial offer.

The trial offer includes our time for our technicians to setup the website for the end user, the price of the
selected domain name, the price of the shared hosting for one (1) month as well as 24x7 email technical support
for one (1) month given to The End User by The Company.

Should The End User decide to keep the website, they will be required to pay immediately within 24 hours of the 30
day trial offer end, the full outstanding balance of the complete website for the first year.  This amount will be
in the sum of $400 USD and to maintain their service every year, The End User will be required to pay $249 USD
per year.

If The End User does not pay for their service within the 24 hour period after the trial offer is over, The Company
has the right to put The End User's website offline and remove their website from The Company's website hosting servers.

Should such an action occur, The End User agrees that The Company will not be held liable for any loss and/or damages
related to the removal of The End User's website and all related services due to non-payment from The End User within
the timeframe specified.

IV. TIME FRAME FOR DELIVERY

The Company upon receiving the order for a promotional website package will do its very best to
achieve a one week turnaround time to get the website up and running, however there may be times
when a one week turnaround time will not be feasable by The Company and thus we do not guarantee
a one week turnaround time.  The End User acknowledges this stipulation and agrees that there will
be no refunds, discounts, credits or dues owed to The End User if we cannot meet a one week
turnaround time.

Due to the nature of the website product/service, it is NON-REFUNDABLE after purchase.  The End User
agrees that their purchase is final and they understand that they are responsible to uphold their
end of this agreement.

The promotional offers will begin upon website going up.  For example if The End User purchases a website
and The Company has the website ready and online in one week, that one week will NOT be considered a part
of the time for either the promotional $499 package or the $99 trial offer.  The End User will receive a
FULL YEAR from date of website going live for the $499 promotional package and a FULL 30 DAYS from date of
website going live for the $99 trial offer package.

V. WEBSITE TRAFFIC AND GROWTH

Over time if The End User's website starts to become active to a level which exceeds regular shared
hosting capabilities, they will be required to convert over to dedicated hosting at an additional
monthly fee.  At any time should The Company decide that The End User's website is effecting other
clients on the same shared server, The Company has the right to remove the website without prior
written notice.  The End User will get in writing the reason for removal and will then have to take
the steps outlined to re-activate their service on a dedicated server or forefit the website with no
refunds, discounts, credits or dues owed to The End User by The Company.

VI. DELIVERABLES BREAKDOWN

The End User agrees that they will receive the following for any of the three (3) promo packages:

1. The End User may purchase an unlimited number of promotional $499 packages during the promotion period
which may end at any time without warning at the discretion of The Company

2. The End User will receive a fully functional website with starter content which can be
updated by The End User.  The website may be open-source or created by The Company.

3. The End User will receive a backend system to update their website

4. The End User will receive one (1) Domain Name with one of the following extensions: .com, .org, .net, .ca;
of an available domain name registered for the period of 1 year.  If The End User decides that
they wish to transfer and use their own domain name, they will receive no refunds, discounts,
credits or dues from The Company and will forefit the included Domain Name registration.

5. The End User will receive one (1) Year of Shared Hosting which will include:
    a. 1 GB of Monthly Data Transfer
    b. 25 Email Accounts
    c. 1 GB of storage space
    d. 1 MySQL Database
    e. PHP Programming Capabilities
Should The End User already have hosting with another company which they wish to use, they must
provide The Company with details and access codes for The Company to install the website onto the
host.  Also The End User will then forefit the included 1 Year of Shared Hosting and will receive
no refunds, discounts, credits or dues from The Company.

6. The End User will receive a low yearly renewal fee of just $249 USD per year which will include
the fees required to pay for the Shared Hosting, Domain Name Registration and our Email Technical
Support Ticketing System.  Should the user not use our Email Technical Support Ticketing System,
and/or not use the included domain name and/or not use the included hosting, they will receive no
refunds, discounts, credits or dues from The Company.

VII. CONTRACT DETAILS

There is no contract or obligation to continue.  The End User may choose to end their website service at
any time however they will receive no refunds, discounts, credits or dues from The Company if they do
decide to end their website services early.

VIII. RENEWAL

The End User may renew their package for just $249 USD per year.  At any time this fee may be changed
by The Company and The End User will be informed of such changes.

IX. LIABILITIES

The Company will not be held liable for any damages related to any websites owned by The End User
which were created by The Company.  The views of The User are not the views of The Company and we
will not be held liable for any damages that may arise from the usage of any of the created websites
by The End User should The End User abuse and/or conduct unlawful or harmful behaviour on their websites.
Example: Placing porn on websites, placing illegal MP3 files, etc.

X. TERMINATION

The Company will in its sole discretion terminate a website purchased by The End User if it is reported
to The Company or found by The Company that The End User has done things which are in violation.
These items are listed below and if any of them are found, The Company may remove The
End User's website without notice and without refund, credit, discounts or dues owed to The End User:

a. Pornography or any derivitaves (Child Porn, etc.)
b. Illegal MP3's
c. Hate Crimes/Racism/Terrorism or the like
d. Any website that goes against local or state/provincial laws

XI. CHANGES TO THIS AGREEMENT

The Company has the right to make changes to this agreement without notice.  The Company makes
no warranties or guarantees either expressed or implied other than what has been stated.
